Sen. Francis Escudero speaks out on the killing of 17-year-old Kian delos Santos

"Kung totoo ang lahat ng alegasyon ng testigo laban sa mga pulis, hindi lang abusadong mga pulis 'yan, kriminal ang mga pulis na 'yan," Senator Francis Escudero said Monday on the recent killing of Kian delos Santos, a 17-year-old boy who was shot dead by the police in an Oplan Galugad operation in Caloocan last week.

Speaking to Unang Hirit anchor Ivan Mayrina, Escudero said that he and his fellow lawmakers would want to get to the bottom of what really happened when they open a Senate investigation on Thursday, August 24.

"Una 'yung facts. Ano ba talaga ang nangyari? Dapat maestablish," he said. "Kung tama 'yung alegasyon na kinaladkad siya, binigyan ng baril, sinabi na 'magpaputok ka at tumakbo ka,' kung totoo 'yun, maliwanag na paglabag sa batas 'yun, hindi lang sa SOP (standard operating procedure), paglabag na 'yan sa revised penal code. Pagpatay 'yan ng tao."

In a separate interview with Pinky Webb on her CNN Philippines program The Source, Escudero also slammed Philippine National Police (PNP) Chief General Bato Dela Rosa for defending the rise in the number of deaths arising from anti-drug operations.

"Hindi na nakakatuwa si General Dela Rosa, sa totoo lang. Noong una, nakakaaliw pa eh, kakaibang magsalita, pero itong mga banat at hirit niya na parang ordinaryo na lang [ang patayan]," he said. "Alam mo naalala ko dito, Pinky, ay unti-unti nang namamanhid ang tao e na okay lang 'yan, normal lang 'yan. parte lang 'yan ng buhay kasi hindi natin kapatid, pinsan, nanay o tatay 'yung napapatay."

Escudero, who ran for the vice presidency during last year's election, also reminded the police that they would still be held accountable after President Rodrigo Duterte ends his six-year term in 2022.
(Mr. Duterte himself has said on several occasions that he would pardon police officers who would be convicted in performance of their duties.)

"Pwede silang sumipsip ngayon at sumunod sa mga sinasabi ng nakakataas sa kanila ngayon pero darating at darating ang panahon na papanagutan nila anumang ginawa nila sa ilalim ng administrasyong ito," Escudero said.

Commenting on claims that delos Santos was a drug runner, Escudero said that it still doesn't justify his death.

"Runner man, tulak man, addict man, 'pag wala nang laban at nasa kustodiya na [ng pulis] hindi dapat pinapatay o binabaril," he said. "Mahirap man unawain, mahirap man intindihan, 'yun ang sinasaad ng batas. Siguro mararamdaman lang natin at nila 'yun kapag sila na ang biktima ng ganoong uri ng pagtrato at paglabag sa karapatang pantao."

He added: Nagalit 'yung [mga] tao kasi inosente 'yung bata, grade 11, bata pa. Mabait ayon sa kanyang mga kaklase at teacher. Pero kahit na totoong tulak pa, mamatay tao, hindi pa rin tama na gawin ng pulis laban sa kanila 'yan."
